Oklahoma Advance Directive Form
An Oklahoma advance directive outlines a principal’s healthcare preferences if they cannot make decisions due to incapacity. It also allows another person (the agent) to make their medical choices under these circumstances. Incapacity can result from various conditions, including severe injuries, dementia, or terminal illnesses.
The advance directive is only effective if the principal completes and signs it while they are mentally competent. This step is particularly vital for those facing terminal conditions, as it prevents the need for a court to appoint a conservator—a process that can be lengthy and burdensome for loved ones.
The designated agent in the advance directive is responsible for understanding and adhering to the principal’s healthcare wishes as laid out in the document. These wishes may encompass the individual’s treatment preferences, life goals, spiritual or religious beliefs, and views on their condition and potential treatments. The agent must make healthcare decisions that honor the principal’s values, especially in situations not explicitly covered in the directive.
Furthermore, the advance directive allows the principal to grant or withhold the authority to make various healthcare decisions from the agent. This element includes choosing the healthcare team, determining living arrangements for care, managing access to medical records, and selecting hospice care providers. Selecting a capable and trustworthy agent is essential to ensure these decisions align with the principal’s wishes and best interests.
