Kentucky small estate affidavit (Form AOC-830) is a legal form that eases transferring assets when someone has died, as long as their estate is worth $30,000 or less. This affidavit allows close family members to avoid the probate court process, providing quicker access to the deceased’s assets. Kentucky does not set a waiting period after death to file this form, and it applies to both U.S. citizens and non-citizens. The affidavit requires notarization for validation purposes and must include the deceased’s social security number (SSN). Primarily, it ensures that a surviving spouse can receive up to $30,000 from the estate without probate. If the deceased has no living spouse, the children receive the estate and must divide it.
