The Texas Quit Claim Deed is the state-official form that transfers ownership of property from one person (the Grantor) to another (the Grantee). As the most straight-forward of the many deed-types, the contract can be completed without the use of an attorney (although consulting one is always recommended). Unlike other types of deeds, it offers no protection to the Grantee(s) in that the property does not have any guarantees that the Grantor actually possesses the property.

Requirements

Grantee’s Address (Section 11.003): The Grantee’s mailing address must be stated in the form or in a separate document attached to it that bears the signature of either the Grantor or Grantee. If the address is not provided, a fee of twenty-five dollars ($25.00), or twice the statutory recording fee (whichever is greater) will be issued.Signing (Section 13.001 and Section 121.001): State law requires all deeds to be signed by the Grantor and notarized.How to File: Once all required fields have been complete and the deed has been signed by all parties, it should be filed at the Recorder’s Office in the County Clerk’s Office where the property is situated.
