Florida Sublease Agreement

A Florida sublease agreement is a legal contract between two parties (the sublessor and the sublessee) that grants the sublessee the right to use a property owned by the sublessor for a specified period of time. This agreement outlines the terms and conditions of the rental, including the monthly rent, the length of the agreement, and any other restrictions or obligations the parties must follow.

Florida has no specific statute regarding subleasing – whether or not the tenant has the right to sublease depends upon the conditions in the original lease signed with the landlord.

SAMPLE: FLORIDA SUBLEASE AGREEMENT

 

This Sublease Agreement (the “Agreement”) is made by and between [SUBLESSOR NAME], (the “Sublessor”) and [SUBLESSEE NAME] (the “Sublessee”) with an effective date of [MM/DD/YYYY].

1. PROPERTY. The Sublessor hereby subleases to Sublessee the following real property located at [RENTAL ADDRESS] (the “Premises”).

2. TERM. The Premises shall be leased for a term of [LEASE TERM]. The Sublessee shall pay the Sublessor monthly rent in the amount of $[MONTHLY RENT] on the [# (e.g,. ‘1st’)] of each month throughout the term of the Sublease. In addition, the Sublessee shall be responsible for all utilities and other services associated with the Premises.

3. SUBLEASEE. The Sublessee agrees to abide by all of the terms and conditions of the primary lease agreement between the Sublessor and the landlord (the “Primary Lease”). Sublessee agrees to indemnify and hold the Sublessor harmless from any claims or liabilities arising from the Sublessee’s breach of the Primary Lease.

4. LIABILITY. The Sublessee agrees to be solely responsible for any damage to the Premises or personal property located within the Premises and to repair or replace said damage at their own expense.

5. DEFAULT. If the Sublessee fails to make a rental payment or violates any other terms of this Agreement, the Sublessor may terminate this Agreement and pursue all remedies available under the law.

6. JURISDICTION. This Agreement shall be construed in accordance with the laws of the State of Florida.
