Hawaii Sublease Agreement

The Hawaii Sublease Agreement is a document that gives a tenant that is actively locked into a lease the means to introduce a new tenant (called the “sublessee”) to live in the residence in exchange for monthly rent payments. Hawaii Law (§ 521-37) gives tenants permission to sublet the property without notifying the landlord as long as it wasn’t specifically prohibited by the landlord in the lease agreement. Before signing the agreement, it is highly recommended that a licensed realtor or attorney read through the document to ensure it amply protects the parties involved.
