The New York Minor Child Power of Attorney is a document that establishes the required legal grounds for an individual other than a child’s parents or legal guardians to absorb either specific or general responsibilities associated with the child’s welfare. The parents/guardians agree to delegate certain decision making powers to the individual (a party known as the Agent) so that they can assume the role of the child’s temporary guardian. The primary reason parents or guardians choose to pursue this type of legal arrangement is to anticipate circumstances out of their hands which cause them to be absent from their child.

Signing Requirements (§ 5-1501B) – The parents/guardians as well as the individual they have selected to act as the Agent are required by the law to sign and date the Minor Child Power of Attorney.
