Montana Limited Power of Attorney Form
A Montana limited power of attorney enables a principal to authorize an attorney-in-fact to act in their place while carrying out specified activities. The principal must explain the duties in depth so that the agent is clear on how to complete them.
Agents are fully responsible for their decisions and actions, especially if they make adverse decisions or those that challenge the principal’s instructions or wishes. Therefore, the individual must fully accept the terms and conditions before signing and ensure they know what they need to achieve. The form automatically ceases once the agent completes the tasks or the principal nullifies the agreement, becomes severely injured, terminally ill (incapacitated), or dies.
Signing requirements (§ 72-31-305): Signed by a notary public.
