Delaware Springing Power of Attorney Form
The Delaware springing power of attorney permits an individual (a party referred to as the Principal) to delegate the handling of any financially-related tasks to another individual or entity (a party referred to as the Agent). A unique feature of this type of POA is that it will only “spring” into effect once the stipulated conditions have been met. This may be after the passing of a certain period of time, such as a certain date. Alternatively, it may be once a particular event has occurred, such as the Principal’s incapacity.

Signing requirements (§ 49A-105) – Must bear the signature of the Principal as well as the date of execution, of which were both completed before a Notarial Officer and one (1) adult witness.
