Arizona Durable Health Care Power of Attorney Form

The Arizona Durable Health Care Power of Attorney is a written, legally-binding representation of an individual’s decision to designate an Agent to make and communicate health care decisions on their behalf. In line with § 36-3223, the Agent can only act on the Principal’s behalf when they are unable to do so themselves. This law also states that the Agent’s authority is “limited only by the express language of the health care power of attorney or by court order,” so it is vital the Principal conveys their health care wishes in a clear manner.

Signing Requirements (§ 36-3221(3)) – A Durable Health Care Power of Attorney in the state of Arizona must be notarized or witnessed by at least one (1) qualified individual.
